Terms of Business

It is mutually agreed that the following terms form an integral part of any contract made by 'Dixon and Dixon Photography' and 'The Client' and that no variation or modification of the contract shall be effective unless accepted by the both parties in writing.

Booking Fee

A booking fee of 30% for Wedding Bookings and Portraits Sessions is charged when the client signs the contract. The fee is deducted in full from the total price on completion of the contract. The booking fee is non-refundable if cancelled less than six months for Wedding Bookings and two weeks for Portrait Sessions from the booked date as being the agreed loss of business suffered by the photographer. Wedding Bookings and Portrait Sessions that are postponed will only be accepted in writing and the photographer will retain the booking fee until the Wedding Booking or Portrait Session is re-scheduled to a date mutually agreed between the photographer and the client.

Payment

The balance of all fees due, are to be paid one week before the Wedding Booking and one day before the Portrait Session or in cash on the day.

Payment for additional photographs will be made at the time of the booking. All print orders shall be deemed as an extension to this contract.

No images or photographs will be released until the full payment is received.

Display and Marketing Materials - Model Release

On signing of the Model Release Form, the client hereby allows the photographer to display any photographs in this contract at his studio/portfolio and as advertising in the press, printed materials, on-line advertising and social media channels. The photographer agrees not to use the photographs for other capital gain except with the permission of the client.

Photographs and Print Orders

The photographer will provide a pleasing colour balance but cannot guarantee exact matching owing to anomalous reflectance caused by a combination of dyes and materials, especially with man-made fibres and the photographic printing process. It is sometimes impossible to record and recreate the exact colour of all the materials as seen by the human eye. All printing orders and instructions are to be given in writing.

The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the act and an offence to copy or allow anyone to copy, sell for capital gain, or use commercially, any of the photographs covered by the contract without written consent from the photographer.

Artistic Licence

The photographer shall be granted artistic licence in relation to the poses photographed and the locations used.

The photographer’s judgement shall be deemed correct.

Force Majeure

The due performance of this contract is subject to alteration or cancellation by the photographer owing to any cause beyond his control. In the unlikely event of total failure or cancellation of this contract by the photographer, liability shall be limited to a refund of all moneys paid.

Digital Files and Negatives

All original negatives and digital files remain the property of the photographer. They will be kept on active file for a period of six months after the photo shoot after which a search fee of £30 will be charged in addition to reprint prices in force at the time. Files will be kept for not less than ten years.

Complaints

All complaints must be received within 28 days from the shoot date in writing. In the unlikely event of an unresolved complaint, the client may request the Master Photographers Association to act as an independent conciliator. Their recommendations will be accepted as final.

Special Offers and Gift Vouchers

No change given, transfer or monetary value to any offers or purchased gift vouchers. Sessions are limited to 4 people per picture. A charge of £10 per person will be added for extra sitters. 'Special Offers' are limited to one session per family per year. Cannot be used in conjunction with any other offers or discounts. All offers and gift vouchers must be redeemed within the time period stated.

We never share, sell or disclose to a 3rd party, any of the information that we acquire about you. Your information will be stored securely and correctly for a period of not less than ten years. After which it will be disposed of in a secure manner.

Subscription Policy

Only one voucher per session with one sitter can be used. No monetary value to this offer or change given. New-Born and Baby’s up to the age of 11 months apply. Can be against new-born/baby gift vouchers purchased during September for future sessions after the closing date. Cannot be used in conjunction with any other discounts or offers.
